2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 318(4), 308(5), 309(4), 317(2) & 3(5) of the BNS and under Sections 25(1-b)(a), 26 and 35 of the Arms Act.

3. The case of the prosecution, in short, is that there is allegation against the petitioner that he has snatched the mobile of the informant.

4. Learned counsel for the petitioner submits that from perusal of the FIR it is clear that the mobile phones which have been snatched are of Realme and VIVO company whereas the mobile which has been recovered from the petitioner is of

Patna High Court CR. MISC. No.87660 of 2025(3) dt.18-02-2026 2/2 Samsung company. It has further been submitted that a similarly situated co-accused Gaurav Kumar has been granted bail by this Court vide Cr. Misc. No. 83865 of 2025. Learned counsel for the petitioner has submitted that the petitioner is languishing in judicial custody since 08.09.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the bail and has submitted that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hajipur Sadar P.S. Case No. 629 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
