The petitioners seek pre-arrest bail in connection with Navanagar P.S. Case No. 253 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information about keeping the liquor at the brick kiln of Sunil Yadav of village Katalpur Badhar, the informant, along with other police personnel, reached there and recovered 164 cartons, each containing 48 bottles of 180 ml. Information was also received to the effect that Santosh Yadav with the help of his associates Krishna Yadav (petitioner no. 1) has kept cartons of liquor with the consent of brick kiln owner, Sunil Yadav, and the cartons of

Patna High Court CR. MISC. No.82788 of 2019(2) dt.13-12-2019 2/2 liquor was being watched by Harihar Yadav (petitioner no. 2). Submission is that both the petitioners were not apprehended on the spot. Mere on suspicion, the petitioners are implicated in this case. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Navanagar P.S. Case No. 253 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise, Buxar, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
