The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 504, 506 and 427 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the allegation against the accused person in the FIR is that they assaulted the family members of the informant with iron rod, bhala and etc. causing injury.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner. It is next submitted that

Patna High Court CR. MISC. No.4791 of 2024(2) dt.21-02-2024 2/2 Shambhu Sahni and 8 others had moved this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 55477 of 2023 (Annexure-4) and the same was allowed by a learned coordinate Bench by an order dated 08.11.2023, it is next submitted that the case of the petitioner is on a much better footing.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Goraul P.S. Case No. 103 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
