Petitioner is apprehending his arrest in Rafiganj P.S.Case No.76 of 2018 registered for the offences under Sections 420, 406, 467, 468, 471, 120(B) of I.P.C.

Petitioner is said to be Secretary of the College and there is allegation against her that she along with the Principal of the College and Lecturer of Physics has defalcated government money a sum of Rs.5,39,163/-.

Submission of the learned counsel for the petitioner is that the aforesaid amount was used in making payment of salary to the professor and staff of the college appointed prior to 19.4.2017 there was no defalcation so far the aforesaid amount is concerned. Moreover, the Principal and the Professor have been granted

Patna High Court Cr.Misc. No.46042 of 2018 (2) dt.13-08-2018 2/2 anticipatory bail by a coordinate Bench of this Court vide order dated 8.8.2018 passed in Cr.Misc. No.44846 of 2018 which will appear from Annexure-7 to this petition.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad, in Rafiganj P.S. Case No.76 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bond.
