JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks regular bail in connection with Rafiganj P.S. Case No. 142 of 2019 registered for the offence punishable under Section 395/412 of the IPC. As per prosecution, there is allegation of looting of the motorcycle of the informant. It appears that petitioner is not named in the F.I.R. Later on, his name transpires in this case on the confessional statement of the co-accused. It further appears that one stolen motorcycle was recovered from the house of the petitioner.
Submission of learned counsel for the petitioner is that stolen motorcycle which has been recovered is in connection with other case, not in connection with the present case. He is in custody since 21.08.2019.
Heard learned A.P.P. also, who has opposed the prayer
Patna High Court CR. MISC. No.80570 of 2019(3) dt.13-01-2020 2/2 for bail.
Having heard both sides, in view of the submissions, made above, at this stage, I am not inclined to grant bail to the petitioner. However, he is at liberty to renew his prayer for bail, after framing of the charge sheet.
With the above observations, this application is dismissed.
