This application for grant of anticipatory bail arises out of Turkauliya P.S. Case No. 645 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379 and 504 of the Indian Penal Code.

It is alleged in the F.I.R. that ten named accused persons were cultivating the field of the informant, which was protested by the informant and his family members. It is alleged that the accused persons started assaulting the informant and his family members. There is allegation against co-accused Ramesh Singh of having hit the informant with an axe. Allegedly, other co-accused persons surrounded the informant and his family

Patna High Court CR. MISC. No.83679 of 2019(3) dt.02-07-2020 2/3 members and assaulted them. There is allegation against Appu Singh of having fired a shot but no one received any gun shot injuries.

Learned counsel appearing on behalf of the petitioner appears to be correct in his submission that there is no direct allegation against the petitioner of any specific overt act. He has stated that the land dispute between the parties is the reasons behind the occurrence, leading to the registration of F.I.R., containing false allegations.

Be that as it may, considering the background, in which, the occurrence had taken place and submission made on behalf of the petitioner, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya P.S. Case No. 645 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as
