2. This application, for grant of anticipatory bail, arises out of Sindhugarh Police Station Case No. 05 of 2024, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The prosecution case, as per the First Information Report, is that on 08.03.2024, the informant got secret information that in a Bolero car huge quantity of illicit liquor was being transported which was coming from Jharkhand. The police intercepted the Bolero vehicle. The person, driving the vehicle, fled away after leaving it. Upon search, police

4. Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case being the owner of the vehicle, whereas, the registered owner of the vehicle is Md. Imtyaz and not the petitioner. Learned counsel further submits that petitioner has apprehension of his arrest as during course of investigation based upon an agreement for sale of vehicle in question by Md. Imtyaz in favour of the petitioner, the police is chasing him. The petitioner is having no criminal antecedent.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that petitioner is having no criminal antecedent and the registered owner of the vehicle is Md. Imtyaz, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.-V, Gaya, in connection with Sindhugarh
