ANJANA MISHRA ORAL ORDER 21-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 20.06.2018 in connection with Jamalpur P.S. Case No. 173/2014 registered for the offences punishable under Sections 395/397 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that though the petitioner is not named in the First Information Report yet his name has transpired in the confessional statement made before the police which has no evidentiary value. It is further submitted that besides the present case, the petitioner has two other criminal antecedent and in the same, he is already on bail. It is also submitted that, till date, he has not been placed on T.I. Parade and similarly situated co-accused persons have since been given the privilege of regular bail passed in Cr. Misc. No. 32943
Patna High Court Cr.Misc. No.47104 of 2018 (2) dt.21-08-2018 2/2 of 2018 vide order dated 04.07.2018 and Cr. Misc. No. 26666 of 2018 vide order dated 09.07.2018.
In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger, in connection with Jamalpur P.S. Case No. 173/2014.
