2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Nadi P.S. Case No. 187 of 2022 (S.T. No.1172 of 2024), lodged on 11.05.2022, under Section 304B/34 of the Indian Penal Code.
3. Earlier prayer for bail of the petitioner was rejected vide order dated 19.04.2024 passed in Cr. Misc. No.10358 of 2024.
4. Learned Counsel for the petitioner submits that at the time of rejection of the bail liberty was granted to the
Patna High Court CR. MISC. No.5273 of 2025(6) dt.20-06-2025 2/3 petitioner to renew his prayer for bail after nine months and trial Court was directed to expedite the trial. Counsel submits that charge has already been framed in this case. Counsel submits that the date of occurrence is 10.05.2022 and on that very day the petitioner was not present in town rather he was in Hyderabad and he returned at the place of occurrence only on the next day i.e., 11.05.2022. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that liberty was granted to the petitioner to renew his prayer for bail after nine months. Counsel submits that progress report has been called for.
6. On perusal of the progress report it transpires that at present out of six prosecution witnesses, three witnesses have been examined and summons have been issued to other witnesses.
7. In the present facts and circumstances of this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Additional Sessions Judge-IV, Patna City, Patna,
Patna High Court CR. MISC. No.5273 of 2025(6) dt.20-06-2025 3/3 in connection with Nadi P.S. Case No. 187 of 2022 (S.T. No.1172 of 2024), subject to the conditions as laid down U/s 480(3) of the BNSS, 2023.
