The petitioner apprehends his arrest in connection with Keoti P.S. Case No. 120 of 2019 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 38(1) of Bihar Excise and Prohibition Act, 2016.

Prosecution case is that during the patrolling duty, the informant received information that illegal liquor is being manufactured in village- Ramsala. Upo0n this information, the police party raided in village- Ramsala and during the course of raid, Brahamdev Paswan, Raju Paswan, Brind Paswan, Wakil Paswan (petitioner), Kari Paswan, Umesh Paswan, Shri Paswan, Ram Bharosh Paswan, Rambabu Paswan, Mahendra Paswan,

No.84013 of 2019(2) dt.14-02-2020 2/2 Ramanand Paswan, Satyanarain Paswan, Agnidev Paswan were found indulged in manufacturing and selling of illegal liquor, who all seeing the police fled away. The police chased but they could not be apprehended. Thereafter, police seized 10 small Aluminum Tasla, one big gas cylinder, 3 small gas cylinder, gas chulha-5, plastic gallon-6, tablet- 5 packet, plastic balti-1, one big gallon, small gallon-5, Meetha-10 kg. country made chulai liquor- 115 litres.

The petitioner is named in the F.I.R. There is direct allegation against the petitioner that he along with other named accused persons are indulged in manufacturing and selling of illegal liquor.

In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.
