2. The petitioner seeks bail in connection with Begusarai Muffasil P.S. Case No. 285 of 2023 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)(a), 26, 35 of the Arms Act.

3. This is the second attempt by the petitioner for bail. Earlier, this Court vide order dated 21.06.2024 in Cr. Misc. No. 27042 of 2024 had dismissed the bail of the petitioner.

3. As per the prosecution case, one country made pistol has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that one of the co-accused has been granted bail by this Court vide order dated 01.11.2023 in Cr. Misc. No. 69479 of 2023. The petitioner is in jail since 18.05.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the period of custody and the fact that similarly situated co-accused has been granted bail by this Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 285 of 2023, subject to the following conditions:

(i) One of the bailors shall be a close relative of the petitioner.

(ii) The petitioner, after being released on bail is directed to mark his attendance at Begusarai Muffassil Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

(iii) Petitioner shall co-operate in
