JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Sambhuganj P. S. Case No. 232 of 2019, disclosing offences under Sections 379, 411 of I.P.C., and Section 8 BM (PIMTS) Rule 2003 & 40 BMMC Rule 1972 & 15 Forest & Environment Protection Act, 1986. Petitioner happens to be the driver and owner of the vehicle and there is allegation of illegal mining of sand by them. Submission of learned counsel for the petitioners is that petitioner no.1 is a licensee, which will appear from Annexure- 2 issued by the District Mining Office, Banka. Heard A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.83131 of 2019(2) dt.21-01-2020 2/2 submissions, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned ACJM-II, Banka, in connection with Sambhuganj P.S. Case No. 232 of 2019.
