2. The petitioner is apprehending his arrest in connection with Muffasil P.S. Case No. 16 of 2023 for the offence under Sections 406, 420 and 34 of the I.P.C.
3. As per the prosecution story, the petitioner in association of one co-accused is said to have taken money from the informant for registering the sale deed but neither the sale deed was registered nor the money was returned.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that an agreement was prepared by the coaccused namely, Vijay Singh wherein it is stated that all alleged amount has been taken by him. The petitioner has neither committed the alleged offence nor has received the consideration amount. He submits that there is no specific overt
Patna High Court CR. MISC. No.86795 of 2025(2) dt.18-12-2025 2/2 act against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application. Learned counsel further submits that other co-accused namely Ashok Thakur has been granted bail by a Co-ordinate Bench of this Court vide order dated 19.09.2023 in Cr. Misc. No. 45702 of 2023.
5. Learned APP opposes the prayer for bail.
6. Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Muffasil P.S. Case No. 16 of 2023 subject to the conditions as laid down under Section 482 of B.N.S.S., as also with the condition that one of the bailors should be close relative of the petitioner.
