The petitioner seeks regular bail in connection with Special Case No. 9618 of 2019 arising out of Nadi P.S. Case No. 268 of 2019 for the offence registered under Section 30(a) of the Bihar Prohibition & Excise Act, 2018.

The allegation is regarding recovery of 60 litres of illicit liquor from the motorcycle of the petitioner. The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 28.10.2019.

Having regard to the facts and circumstances of the

Patna High Court CR. MISC. No.85469 of 2019(2) dt.07-01-2020 2/2 case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to direct the petitioner herein to be released on bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 9618 of 2019 arising out of Nadi P.S. Case No. 268 of 2019.
