2. The petitioner apprehends his arrest in a case registered for the offence under Sections 8(b), 18, 29 of the N.D.P.S. Act.
3. As per prosecution case, this petitioner alongwith other co-accused persons, named in the F.I.R., are alleged to be involved in cultivation of opium plants on large scale in the protected forest area.
4. Learned counsel for the petitioner submits that only on suspicion, this petitioner has been made accused in this case. The alleged field, on which opium plants were being cultivated, does not belong to this petitioner, rather it belongs to the forest area and there is no evidence to show involvement of petitioner in the alleged cultivation of opium plants. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Dhangai P.S. Case No. 14 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
