The petitioner has filed the instant application for grant of regular bail in connection with Bettiah (Town) P.S. Case no. 858 of 2018 registered under sections 30(a), 33, 35 and 38 of the Bihar Prohibition and Excise Act.

As per allegation in the F.I.R., 53.41 litres of IMFL was recovered from the house of Ramdev Singh. It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in the confessional statement of co-accused Ramdev Singh made before the police. No incriminating material has been recovered from the house or possession of the petitioner who is in custody since 21.8.2019.

Having heard learned counsel for the parties and in the facts and circumstances of the case and in view of the petitioner being in custody since 21.8.2019, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Bettiah (Town) P.S. Case no. 858 of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Bettiah, West Champaran.
