Petitioners seek bail in Baruily P.S.Case No.219 of 2016 registered for the offences under Sections 304(B) and 34(B) of the I.P.C.

Allegation against the petitioners who happen to be devar and gotani of the deceased, is of dowry death. Submission of the learned counsel for the petitioners is that there is no specific allegation of any overt act attributed to the petitioners and they are in custody since 14.6.2018 having no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named,

Patna High Court Cr.Misc. No.46903 of 2018 (3) dt.19-09-2018 2/2 be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj, in Baruily P.S. Case No.219 of 2016 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
