Petitioners are apprehending arrest in connection with Excise Case No. 194 of 2019 for the offence under sections 414 of the Indian Penal Code and section 30 (a) of Bihar Prohibition and Excise Amendment Act, 2018. Learned counsel for the petitioners submits that petitioners have no criminal antecedent. He submits that with regard to seizure of 29.16 liters of liquor, the petitioners have been roped after 26 days. He further submits when the police failed to ascertain the owner of the seized article then the police registered a case against unknown.

No.82065 of 2019(2) dt.11-12-2019 2/2 Considering the fact that name of the petitioners figured in the instant case after recovery of liquor after 26 days, the court is inclined to grant bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise act, Bettiah, West Champaran, in connection with Bettiah Sadar Excise Complaint Case No. 194 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.
