JUSTICE BIRENDRA KUMAR ORAL ORDER 25-10-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
Daughter of the informant was married with co-accused Meraj Ansari. Meraj Ansari is already in custody. The daughter of the informant died along with her two children in unnatural circumstances.
Submission of the learned counsel for the petitioner is that though allegation in the FIR is that the victim was assaulted to death but the doctor has not found any external injury on the person of the dead body nor any witness has supported the allegation of assault. In fact the husband of the deceased had lent
Patna High Court Cr.Misc. No.53917 of 2018 (4) dt.25-10-2018 P2/ money to the brother of the deceased through the deceased and for refund of the said amount there was quarrel between husband and wife and the wife along with her two children jumped into water to commit suicide.
Considering the entire facts aforesaid, let the petitioners, who are relations of the husband, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ramgarh Police Station Case No. 75 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
