JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Mansi P.S. Case No. 74 of 2019, dated 27.04.2019, instituted for the offences under Sections 323, 504, 506, 341, 307, 324 and 302/34 of the Indian Penal Code.
It appears that while undertaking construction work, the husband of the informant was attacked by one Rajiv Thakur by a pair of scissors leading to his death. Anil Thakur, a co-accused, is stated to have caught hold of the
Patna High Court CR. MISC. No.80865 of 2019(2) dt.10-12-2019 2/3 deceased when he was inflicted with scissor blow. Coaccused/Anil Thakur is also alleged to have injured one Rakesh.
Though the petitioner has been named in the F.I.R., but nothing specific has been attributed against him. It appears that the petitioner is an agnate of the informant and the deceased and merely because he hails from the family of the main accused person who is alleged to have given the fatal blow, he too has been made accused. Two of the ladies of the house, who have been made accused in this case, have been granted anticipatory bail by a Bench of this Court vide order dated 27.11.2019 passed in Cr. Misc. No. 70559 of 2019.
Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl.
