2. The petitioner seeks regular bail in connection with Piprasi P.S. Case No. 51 of 2023 registered on 08.10.2023 lodged under Sections 366 I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against the present petitioner with an allegation that he had kidnapped the daughter of the informant with a view to marry.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since10.10.2023 having no criminal case pending against him. He further submits that age of the victim has wrongly been inserted in this case.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.6700 of 2024(3) dt.09-04-2024 2/2 for bail and submits that this Hon'ble Court has pleased to call for the case diary and Statement under Section 164 of the Cr.P.C. on earlier occasion.

6. Upon perusal of the statement under Section 164 of the Cr.P.C., the alleged victim has accepted that the rape has been committed with her forcefully.

7. In the present facts and circumstances of this case, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, the regular bail application of the petitioner is hereby rejected.

9. Trial Court is directed to expedite the trial aand conclude the same as early as possible.
