====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2026 Heard learned counsel for the petitioner and the State. Despite valid service of notice, nobody appears for opposite party no.2.

2. Petitioner apprehends arrest in a case registered for the offence punishable under section 85 of the Bharatiya Nyaya Sanhita, 2023 and section 4 of the Dowry Prohibition Act.

3. Allegation against petitioner is of matrimonial cruelty and torture with opposite party no.2 for dowry.

4. Learned counsel appearing for the petitioner while denying the allegations, submits that the petitioner has falsely been implicated in this case because he is husband of the victim. Supplementary affidavit has been filed on behalf of the petitioner stating therein that matrimonial dispute between the parties has been amicably and finally resolved vide talaknama dated 14.4.2026, annexure 6 to the supplementary affidavit. Considering the aforesaid facts and circumstances of the case as also the judgment of this Court, in the event of arrest or surrender within eight weeks from today, let this petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Incharge, Sub Divisional Judicial Magistrate, Samastipur in Complaint Case No. 2196/2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
