The petitioner is accused in connection with Belhar P.S. Case No. 225/2019 registered under Sections 341, 323, 307, 379, 384/34 of the Indian Penal Code pending in the Court of Learned C.J.M., Banka.

Submission of the learned counsel for the petitioner is that petitioner is innocent and has falesly been implicated in the present case due to management dispute of school. The petitioner received the injury due to falling from motorcycle and not from the direct assault of any Lathi, there is no injury of laceration, abrasion etc. Petitioner is in custody since 15.08.2019.

Learned APP appearing on behalf of the State

Patna High Court CR. MISC. No.82450 of 2019(2) dt.20-01-2020 2/2 opposed the prayer of the petitioner with submission that from the perusal of Case Diary vide para 17, it transpired that the informant sustained eight injuries out of which injury No. 4 and 5 are grievous and there are criminal antecedent of the petitioner in seven cases of serious offences. Further, charge-sheet has been submitted against the petitioner.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
