2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 302, 323, 341, 504, 506 and 34 of the Indian Penal Code and Sections 27, 25(1-b), 26 and 27 of the Arms Act, registered in connection with Saharsa Sadar P.S.Case No. 248/2024.

3. The informant Raja Kumar alleges that five named accused persons fired indiscriminately on his bother and his brother died.

4. The learned senior counsel for the petitioner has submitted that only one injury was found on the deceased, i.e. fire-arm injury. Co-accused Kari Yadav in his confessional

Patna High Court CR. MISC. No.86947 of 2025(2) dt.12-12-2025 2/2 statement has stated that being infuriated he (Kari Yadav) took out a pistol from his waist and shot the deceased. The learned senior counsel has submitted further that considering the confessional statement of Kari Yadav, though petitioner's prayer for bail was rejected, but it transpired that the petitioner had not fired at the deceased. He is in custody since 06.02.2025.The learned senior counsel also submitted that the informant did not support the prosecution case and he turned hostile.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Saharsa in connection with Saharsa Sadar P.S.Case No. 248/2024/S.T.No. 154/2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
