JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner in the present case is seeking regular bail in connection with Baliya Belon P.S. Case No. 112 of 2019 being G.R. No. 4470 of 2019 registered under Sections 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner and the informant are known to each other and they had got dispute over certain transactions. Learned counsel further submits that the seizure list has been prepared in a very suspicious manner and the recovery of some coins have been shown from the house of this petitioner, the petitioner has no criminal antecedent and has

Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that the petitioner and the informant are known to each other and they had got dispute over certain transactions and further the seizure list has been prepared in a very suspicious manner and the recovery of some coins have been shown from the house of this petitioner, the petitioner has no criminal antecedent and has remain in custody since 01.10.2019 and the investigation against him is complete, let the above-named petitioner be released on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Baliya Belon P.S. Case No. 112 of 2019 being G.R. No. 4470 of 2019, subject to the condition as laid down under Section 437(3) Cr.P.C. as under:

(a) that such person shall attend in accordance
