Petitioner, already in custody, seeks bail in connection with Forbesganj P.S. Case No. 921 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 307, 354B, 379, 504 and 506/34 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was added.

Accusation is that six accused persons started assaulting the informant's cousin, when the informant's sister came for rescue, she was also assaulted over the head with dabiya, and father of the informant was also assaulted with iron rod who succumbed to injury.

Learned counsel for the petitioner submits that there is no specific accusation against the petitioner, the accusation of

No.47731 of 2018(2) dt.06-08-2018 2/2 assault is general and omnibus against six persons but the postmortem report clearly indicates that there is one antemortem injury on the head of the deceased and that is not attributed to petitioner, who has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner, Chandan Kumar Sah @ Chandan Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Forbesganj P.S. Case No. 921 of 2017.
