JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2018 The petitioner seeks regular bail in connection with Sessions Trial No. 193/2018 arising out of K. Hat (Maranga) P.S. Case No. 44 of 2018, registered for offences punishable under Sections 363, 364, 365, 302, 201/34 of the Indian Penal Code. Allegation against the petitioner and co-accused of this case is of kidnapping the son of informant and committing his murder.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case only on the basis of suspicion and he has no role to play in the death of the son of the informant. Further, he has no criminal antecedent and has been in judicial custody since 26.01.2018.

Learned counsel for the State opposed the prayer for bail

Patna High Court Cr.Misc. No.48105 of 2018 (3) dt.01-10-2018 2/2 on the ground that the dead body of the son of the informant has been recovered on disclosure made by the petitioner and further he has also been identified in the CCTV footage. Having heard both sides, considering the fact and circumstances of the case and the nature of accusation, I am not inclined to enlarge the petitioner on bail.

However, the trial court is directed to expedite the trial and try conclude the same as early as possible. With the above observation, this application is dismissed (Vinod Kumar Sinha, J) sunil/- U T
