Petitioners apprehend arrest in a case registered under Section 498A of Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act.
Learned counsel for the petitioners submits that these petitioners are innocent and have committed no offence and they have falsely been implicated in this case on account of ulterior motive and grudge. It is further contended that these petitioners have nothing to do with the alleged offence and they have been
Patna High Court CR. MISC. No.80971 of 2019(2) dt.10-12-2019 2/3 implicated in this case only with a view to harass them. Learned counsel further contended that the petitioners are father-in-law and mother-in-law of the complainant. Learned counsel further contended that conciliation between the parties has already failed.
Learned APP for the State has opposed the prayer and submitted that petitioners are in-laws of the complainant and the reconciliation between the parties has already failed. Considering the rival submissions, this Court is inclined to accept the submission of the petitioners' counsel. Let the petitioners above named, in the event of their arrest or surrender, be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Lakhisarai in Complaint Case No 113C of 2018 subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code and also the following conditions:
