The petitioner apprehends his arrest in connection with C.R. Case No. 308 of 2019 registered for offence punishable under section 498 A of the Indian Penal Code. Heard the learned counsel for the petitioner as well as the learned counsel for the opposite party no. 2. The learned counsel for the petitioner has submitted that the opposite party no. 2 is not legally wedded wife of the petitioner. In this respect, he has filed informatory petition in the court of learned Chief Judicial Magistrate which was registered

Patna High Court CR. MISC. No.1965 of 2020(5) dt.24-12-2021 2/2 as informatory petition No. 534/2018 in which the petitioner has stated that the complainant/opposite party no. 2 has threatened him to implicate in a false and frivolous case if he refuses to marry with her. He has also submitted that the opposite party no. 2 had already filed Complaint Petition No. 1033 of 2015 in the court of learned Sub-Divisional Judicial Magistrate, Samastipur against her husband Pankaj Kumar Raj and his family members which shows that her husband is Pankaj Kumar Raj and not the present petitioner.

Considering the facts and circumstance of the case, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Samastipur in connection with C.R. Case No. 308 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.
