2. The petitioner seeks bail in connection with Islampur P.S. Case No. 559 of 2023 dated 05.10.2023 registered for the offence punishable under Sections 341, 323, 325, 307, 504/34 of the Indian Penal Code and later on Section 302 of the I.P.C. was added.

3. The prosecution case, in short, is that on the alleged date of occurrence at about 5 pm there was quarrel between the informant's daughter-in-law and her neighbour and this altercation escalated into abuse and then into fight. Seeing the fight, the people from neighbourhood went to stop the fight but the accused, namely, Naulesh Ravidas @

Patna High Court CR. MISC. No.1816 of 2025(4) dt.05-03-2025 2/3 Naulesh Kumar hit informant's daughter-in-law on her head with a bamboo stick due to which she started bleeding profusely and the accused persons fled away from the spot. During the course of treatment, she died.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that there is a specific allegation against the petitioner, that he assaulted the informant's daughter-in-law on her head with a bamboo stick due to which she died. The post-mortem report corroborate the allegation against the petitioner. It is submitted that the occurrence took place on 01.10.2023 but the F.I.R. has been lodged on 05.10.2023 after delay of four days without any plausible explanation. It is further submitted that as per the allegation, the petitioner has assaulted by means of bamboo stick on the head of the deceased as such there was no intention to kill her. Lastly, it has been submitted that the petitioner is in custody since 30.08.2024, having no criminal antecedent and charge-sheet has been submitted in the case.

Patna High Court CR. MISC. No.1816 of 2025(4) dt.05-03-2025 3/3 A.P.P for the State opposes the prayer for bail of the petitioner. It is submitted that there is specific allegation against the petitioner, that he assaulted the deceased on her head with a bamboo stick due to which she died.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties as well as specific allegation of assault against the petitioner, I am not inclined to grant bail to the petitioner at this stage.

7. Accordingly, the prayer of the petitioner for grant of bail is hereby rejected.

8. The Trial Court is directed to expedite the trial and take all endeavor to conclude the trial at the earliest, preferably, within a period of one (01) year from the date of receipt/production of a copy of this order. If the trial is not concluded within one year, the petitioner will be at liberty to renew his bail application after one year.
