Petitioner, already in custody, seeks bail in connection with Kotwali P.S. Case No. 17 of 2017 registered under Section 506 of the Indian Penal Code and 3⁄4 of Explosive Substance Act.

Accusation is that, on the closed shop of the petitioner, someone threw the bomb causing damage to the shutter.

The contention of learned counsel for the petitioner is that the F.I.R is against unknown and only on the basis of the confessional statement of one Md. Sikandar @ Suraj @ Jitendra who disclosed the name of this petitioner, there is no material

Patna High Court Cr.Misc. No.47751 of 2018(2) dt.06-08-2018 2/2 against the petitioner and Md. Sikandar @ Suraj @ Jitendra was granted bail by a coordinate Bench of this Court vide order dated 10.07.2017 passed in Cr. Misc. No. 31232 of 2017. Having considered the aforesaid facts and circumstances, petitioner, Md. Asif is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Kotwali P.S. Case No. 17 of 2017.
