The petitioner in this case is seeking regular bail in connection with Majhauliya P.S. Case No. 231 of 2018 registered for the offences punishable under Sections 341, 323, 324, 307, 376, 511/34 of the Indian Penal Code in which Section 302 IPC has been added later on.

Learned counsel for the petitioner submits that similarly situated co-accused Sanjay Ram against whom there was allegation that he caught hold of the husband of the informant while he was assaulted by co-accused Ajay Ram has been granted bail by a learned co-ordinate Bench of this Court in Cr. Misc. No. 3029 of 2019. It is further submitted that the petitioner is in custody since 04.06.2019 having no criminal antecedent.

Patna High Court CR. MISC. No.86393 of 2019(2) dt.18-01-2020 2/3 Learned APP for the State has not controverted the aforesaid submission.

Considering the facts and circumstances of the case and the submission of the learned counsel for the petitioner which has not been controverted by learned APP that the similarly situated co-accused Sanjay Ram against whom there was allegation that he caught hold of the husband of the informant while he was assaulted by co-accused Ajay Ram has been granted bail by a learned co-ordinate Bench of this court in Cr. Misc. No. 3029 of 2019 as also further submission that the petitioner has no criminal antecedent and has remained in custody since 04.06.2019, the petitioner being similarly situated is directed to be released on bail in connection with Majhauliya P.S. Case No. 231 of 2018 on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.

, Bettiah, subject to the condition as laid down under Section 437 (3) Cr.P.C.

Patna High Court CR. MISC. No.86393 of 2019(2) dt.18-01-2020 3/3 (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police officer or tamper with the evidence.
