The petitioners seek anticipatory bail in connection with Naya Ramnagar P.S. Case No. 252 of 2017 registered for the offences under Sections 302 and 201/34 of the Indian Penal Code.

Though the petitioners are named in the F.I.R. but till date they have not been arrested. Even, the Police have not prayed for issuance of any warrant of arrest against the petitioners.

It is the submission of learned counsel for the petitioners that some of the accused persons of the present case have been put on trial and they have been acquitted.

No.81080 of 2019(5) dt.26-10-2021 2/2 In these circumstances, in my opinion, there is no apprehension of arrest and therefore, this anticipatory bail application is not maintainable at this point of time. However, the petitioners have liberty to move before this Court for anticipatory bail as and when there is apprehension of arrest. Accordingly, this bail application is dismissed as not maintainable.
