1. No one appears for the petitioner.

2. Learned counsel for the State is present.

3. The petitioner apprehends his arrest in connection with Harlakhi P.S. Case No. 250 of 2024 dated 23.09.2024 registered for the offence under Section 317 (2), 317(4), 317 (5) of the B.N.S. 2023.

As per the first information report the informant / Police Officer on 23.09.2024 got information that one Indal Yadav was keeping stolen motorcycles in his house, proceeded towards the house of Indal Yadav and raided the same. During the course of raid two motorcycles were recovered from the door of Indal Yadav. Upon inquiry about the ownership of the motorcycles, the said Indal Yadav informed that he is not having any papers of the motorcycles and the same was purchased by him from

Patna High Court CR. MISC. No.90327 of 2024(2) dt.30-01-2025 2/3 Nagendra Yadav i.e. petitioner herein. The Police subsequently raided the house of Nagendra Yadav i.e. petitioner and recovered two stolen motorcycles from his house and the petitioner was found absconding.

5. From perusal of bail application it appears that the petitioner has claimed that he has committed no offence in the manner alleged and the entire prosecution version is concocted and fabricated. The petitioner has been made accused on the basis of dirty village politics. He has been dragged in this case on the basis of confessional statement of the co-accused Indal Yadav.

Learned counsel for the State submits that on the disclosure of the name of the petitioner by the co-accused Indal Yadav, Police raided the house of the petitioner from where two stolen motorcycles were recovered. The petitioner is having four criminal antecedents out of which two antecedents are of similar nature.

Having regard to the submission made by learned counsel for the State and upon perusal of the bail petition and the impugned order it appears that two stolen motorcycles were recovered from the house of the petitioner and the petitioner is having criminal antecedents of similar nature of offence.

Patna High Court CR. MISC. No.90327 of 2024(2) dt.30-01-2025 3/3 Accordingly, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
