2. Petitioner seeks bail who is in custody since 04.10.2025 in connection with Shashtri Nagar P.S. Case No. 572 of 2025 for the offences punishable under Sections 464, 467, 468, 471, 420, 409 and 120(B) of IPC
3. The prosecution story, in brief, is that a loan of Rs. 49,70,000/- was sanctioned in favour of the petitioner by the Bank of Baroda, A.G. Colony Branch, Patna. The petitioner is stated to have represented herself as a salaried employee,
2/4 claiming to be working as a permanent Clerk in the Anatomy Department of PMCH since 10.07.2004. For verification, she submitted her PAN card, Aadhaar card, and a salary/savings account statement of PNB Bank bearing A/c No. 149900170010934. The said account was canvassed by coaccused Gautam Gambhir, a Direct Selling Agent (DSA). A preapproval inspection of the petitioner's residence and employment at A.G. Colony was conducted, which purportedly confirmed her employment at PMCH. However, on 02.02.2024, the branch reported to the Regional Office suspected fraudulent activity involving submission of forged and tampered documents. Suspicion was further strengthened when discrepancies were detected during inspections conducted by co- accused Gautam Gambhir in other loan applications. It was subsequently discovered that the petitioner had not constructed any house against the sanctioned loan and had misappropriated the bank's funds. The salary slips and account statements furnished by her were found to be fabricated, and her claimed employment details were also false.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and is innocent and she has falsely been implicated in the present case. It is further
3/4 submitted that the allegation as alleged in the FIR is forged and fabricated and the petitioner has not committed any offence as alleged in the FIR. Learned counsel for the petitioner further submits that petitioner had already filed a Complaint Case No. 13248 of 2025 stating therein that the other co-accused persons have misused her identity and trapped her without her knowledge.

The learned Additional Public Prosecutor for the State and learned counsel for the Bank, on the other hand, on the basis of materials available on record and the case diary have vehemently opposed the prayer for bail of the petitioner and submit that from bare perusal of the FIR it appears that the petitioner after producing the false documents obtained the loan amount of Rs.49.70 lakhs and she has not returned a single amount as yet.

Considering the aforesaid facts and circumstances that there is direct and specific allegation against the petitioner in the FIR supported by the documents and apart from aforesaid, the petitioner herself has confessed her guilt in the compliant petition, I am not inclined to enlarge the petitioner on bail in connection with Shashtri Nagar P.S. Case No. 572 of 2025 pending in the learned Court of ACJM IX, Patna.
