2. The petitioner apprehends his arrest in connection with Ujiyarpur P.S Case No. 278 of 2025 registered for the offences punishable under Sections 30(a) & 41(1), (2) of Bihar Prohibition and Excise Act, 2022 (Amended).
3. As per the prosecution case, total 26.250 litre of illicit liquor was recovered.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner is not arrested on the spot and no recovery was made from the petitoner.
5. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.87517 of 2025(2) dt.19-12-2025 2/2 for bail of the petitioner.
6. From perusal of the F.I.R., impugned order and materials available on record it appears that petitioner is not arrested on the spot and no incriminating articles have been recovered from the conscious possession of the petitioner. It is further submitted by the petitioner that co-accused has already been granted bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 86669 of 2025 and Cr. Misc. No. 86503 of 2025.
7. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-I, Samastipur in connection with Ujiyarpur P.S Case No. 278 of 2025 subject to the condition laid down under Section 482(2) of B.N.S.S.
