The petitioners seek regular bail in connection with Jagdishpur (Goradih) P.S. Case No. 270 of 2019 for the offence registered under Sections 304(B) and 34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioners having killed the victim deceased lady on account of non-fulfilment of the demand for dowry. The learned counsel for the petitioners submits that the petitioners are the father-in-law and the mother-in-law of the deceased victim lady and were living separately from their son and daughter-in-law as well as they do not have any complicity in the

In any view of the matter, on instruction, it has been submitted by the learned counsel for the petitioners that the son of the petitioners is ready and willing to surrender within a week, as such the petitioners be granted the privilege of regular bail immediately upon surrender of their son. The petitioners are stated to be having clean antecedents and are languishing in custody since 19.08.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present petition with a direction to the learned court below to grant regular bail to the petitioners herein on such conditions as may be deemed fit and proper to be imposed by the learned court of Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur (Goradih) P.S. Case No. 270 of 2019, immediately upon them producing the surrender certificate of their son i.e. the husband of the deceased victim lady.
