====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence registered under Sections 302 and 201 of the IPC. The prosecution story, in brief, is that on 27.06.2019, when the informant being the Choukidar was on duty, he received an information that a dead body of an unknown person has been thrown in the field of Village- Baghoi at Deoghatta Baghar. The said person has been murdered by a sharp cutting weapon. He informed about the unidentified dead body to the S.H.O., Haspura.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 06.11.2019. The petitioner has got no criminal antecedent. Charge sheet has been

Patna High Court CR. MISC. No.81977 of 2019(2) dt.18-12-2019 2/2 submitted in the present case. The petitioner is not named in the F.I.R. His name has come in course of investigation only on the basis of suspicion. Except for this, there is no substantive evidence to suggest the implication of the petitioner in the present case. There is no eye witness to the alleged occurrence. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad, in connection with Haspura P.S. Case No. 77 of 2019.
