2. Petitioner seeks pre-arrest bail in connection with Complaint Case No.788(C) of 2022 registered for the offences punishable under Sections 498(A), 323 & 504/34 of the Indian Penal Code.

3. The present case relates to matrimonial dispute between the petitioner and Opposite Party No.2, who are husband and wife respectively. In the complaint case filed by the Opposite Party No.2, allegations of cruelty and causing hurt for non-fulfillment of dowry have been alleged against the petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and there is

In this regard, in paragraph no.7 of the bail application, the petitioner has stated that he is ready to keep his wife with full care, respect and honour and resume their happy conjugal life.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Having considered the rival submissions made on behalf of the parties, as well as, considering the fact that as per the service report, O.P.No.2 refused to receive the service of notice, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Smt. Nandini Suman, learned J.M. 1st class, Bhojpur/concerned court, in connection with Complaint Case No.788(C) of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
