2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Baheri P.S. Case No. 83 of 2024 instituted for the offence under Section 394 of the Indian Penal Code.

3. The case of the prosecution is that the informant was going on splender bike of his master, four persons on two bikes stopped him, assaulted him and on the gun point, snatched Rs. 3000/-, mobile and the bike. The case was lodged against unknown miscreants. One Dilkhush Kumar was apprehended and he has disclosed the name of this petitioner.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Patna High Court CR. MISC. No.89652 of 2024(3) dt.21-02-2025 2/2 offence. He has falsely been implicated in this case. Nothing has been recovered from the possession of this petitioner. Recovery was made from one Sonu Kumar Singh. No T.I.P. has been conducted. Similarly situated co-accused person has already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 11.02.2025 in Cr. Misc. No.1749 of 2025.

5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner and submitted that petitioner is having criminal antecedent of two cases.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Baheri P.S. Case No. 83 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Darbhanga, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
