The petitioner seeks bail in a case initially registered under Sections- 341, 342, 452, 324, 307/34 of the Indian Penal Code, in which, later on, Sections-323,120(b),201, 379 of the Indian Penal Code was also added.
The prosecution case, in brief, is that when the informant was sleeping in his room, three unknown persons attacked him by knife.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16-03-2018 and the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has already been submitted in this case. The petitioner is not named in the FIR. In course of investigation, his name has come in this case on
Patna High Court Cr.Misc. No.50044 of 2018 (3) dt.13-09-2018 the basis of suspicion. There is no other substantial evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner's name has come in course of investigation.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Siwan in connection with Nautan P.S. Case No. 24 of 2018.
