The petitioners apprehend their arrest in connection with Nathnagar P.S. Case No. 281 of 2019 for the offence punishable under Sections 341, 323, 363, 372, 34 of the Indian Penal Code. The allegation is regarding the co-accused person, namely, Puja Kumari having allured the victim girl and taken her to Bariarpur in her house where she was confined by the said accused person, namely, Puja Kumari with oblique motive.
The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case and are having a clean antecedent. It is further submitted that neither the victim girl nor the informant of this case have alleged any untoward incident having been committed by the petitioners herein and they have been merely roped in the present case on account of the
Patna High Court CR. MISC. No.81974 of 2019(2) dt.21-01-2020 2/2 petitioner No.1 being sister-in-law of the co-accused person, namely, Puja Kumari and the petitioner No.2 being her brother-in-law. It is also submitted that the victim girl had returned after two days and she has not alleged that any untoward incident has taken place with her.
Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners coupled with the fact that no allegation whatsoever has been levelled against the petitioners herein of harming the victim girl, I deem it fit and proper to direct for release of the petitioners on anticipatory bail.
Accordingly, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners, above named, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. I/C, Bhagalpur connection with Nathnagar P.S. Case No. 281 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C.. (Mohit Kumar Shah, J) Tiwary/- U T
