The petitioner seeks bail in connection with Valmikinagar PS Case No. 111 of 2022, FIR dated 10.01.2022, registered for the offences punishable under Sections 376, 341, 323, 504 and 506 read with Section 34 of the Indian Penal Code and under Section 6 and 12 of the POCSO Act.

Earlier the petitioner has moved before this Hon'ble Court for grant of regular bail vide Cr. Misc. No. 11531 of 2023, which was rejected vide order dated 21.06.2023. 4.

Learned counsel for the petitioner submits that he has clean antecedent and falsely been implicated in the present

Patna High Court CR. MISC. No.712 of 2024(3) dt.16-02-2024 2/2 case.

Vide order dated 12.01.2024, a report with regard to the present status of the trial was called for. Report of the learned Trial Court dated 22.01.2024 reveals that all the prosecution witnesses have been examined and the case is pending for recording the statement of the petitioner under Section 311 of the Cr.P.C.

Learned APP for the State vehemently opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and the report of the learned trial Court, I am not inclined to enlarge the petitioner on bail in connection with Valmikinagar PS Case No. 111 of 2022, pending in the Court of learned Additional District & Sessions Judge-VII-cum-Special Judge, POCSO, West Champaran, Bettiah.
