The petitioner seeks Anticipatory bail in connection with Pusa P.S. Case No. 129 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) and 47 of the Bihar Prohibition and Excise Amendment Act, 2016. Allegation against petitioner is of recovery of 99.315 litres from the car.
It has been submitted on behalf of the petitioner that petitioner is not named in the FIR. His name has surfaced in this case on the basis of statement of Sujit Kumar and Sujit Kumar was the owner of the car. There is no specific allegation against petitioner.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.50760 of 2018(2) dt.18-09-2018 2/2 prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge cum Special Judge Excise Act, Samastipur, in connection with Pusa P.S. Case No. 129 of 2017.
