This application for anticipatory bail arises out of Phulwarisharif P.S. Case No. 932 of 2019, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code.

The case diary is available on record. Learned counsel appearing on behalf of the petitioner has submitted that allegedly the occurrence had taken place on 10.10.2019 whereas the FIR was registered on 11.10.2019. She contends that the injury report is of 12.11.2019 without mentioning the date when the medical examination was conducted.

It is alleged in the FIR that the petitioner and coaccused Ravi Kumar had abused the informant, snatched valuables from him and when he raised protest, he was assaulted by them.

No.82574 of 2019(4) dt.17-06-2020 2/2 From the case diary, it appears that one of the witnesses disclosed to the police that there was some dispute between the informant and the petitioner as the petitioner was objecting to the informant indulging in the acts of gambling near his house. The petitioner has no criminal antecedent, as stated in paragraph 3 of the application.

Considering the above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Sub-Judge-IX cum ACJM, Patna in Phulwarisharif P.S. Case No. 932 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
