Petitioner seeks bail in Chakia P.S. Case No.41 of 2018 instituted for the offence under Section(s) 379, 411 and 413 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. He is in custody since 25.03.2018. The vehicle has not been recovered from his possession. The name of this petitioner has come in the confessional statement of co-accused Md. Ali @ Ali Jahan @ Keshar. The vehicle has been recovered from the possession of one co-accused Ragho Prasad.

It has been submitted that co-accused, Ragho

Patna High Court Cr.Misc. No.50124 of 2018 (4) dt.03-10-2018 2/2 Prasad, has already been granted bail by co-ordinate Bench of this Court vide order dated 04.06.2018 passed in Cr. Misc. No.32807 of 2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in connection with Chakia P.S. Case No.41 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
