JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-01-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 342, 120(B), 307, 302, 504 of the Indian Penal Code.
As per the prosecution case, the petitioner along with other co-accused persons entered the house of the informant and shot the father and the uncle of the informant and also caused firearm injury to another uncle of the informant. The co-accused Sita Devi exhorted to shot Pappu Kumar, Amal Kishore Singh and
Patna High Court CR. MISC. No.1724 of 2024(2) dt.24-01-2024 2/3 Nawal Kishore Singh fired on the chest of Pappu Kumar. The co-accused Dilchan Singh and Raushan Singh fired on the Dhananjay Singh, who died on the spot. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing incriminating material has been recovered from the conscious possession of the petitioner. There is land dispute between the parties. Moreover, other similarly situated co-accused person has been granted bail by a coordinate Bench of this Court vide order dated 24.07.2023 passed in Cr. Misc. No. 40209 of 2023. The petitioner is languishing in custody since 15.02.2023. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be
Patna High Court CR. MISC. No.1724 of 2024(2) dt.24-01-2024 3/3 released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in connection with Beldaur P.S. Case No. 178 of 2021.
