The Petitioner seeks regular bail in connection with Tariyani P.S.Case No. 162 of 2013, Trial Number 934 of 2018, registered for offences punishable under Sections 395 and 397 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is of that 50-60 unknown miscreants including the petitioner entered into the house of the informant and assaulted all the family members by means of lathi and rod and thereafter looted away the valuable articles.
Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated on the basis of confessional statement of one co-accused, namely Brij Raj. It is
Patna High Court Cr.Misc. No.52227 of 2018 (2) dt.04-10-2018 2/2 also submitted that the petitioner was already accused in two cases in which he has already on bail and the petitioner is in custody since 16.01.2018.
Heard learned A.P.P also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S.Case No. 162 of 2013, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
