2. The petitioner apprehends his arrest in a case registered for the offence under Sections 8, 18, 29 of the N.D.P.S. Act and Sections 25(10B)a, 26, 35 of the Arms Act.
3. As per the prosecution case, this petitioner alongwith other co-accused persons, named in the F.I.R., are alleged to be involved in cultivation of opium plants on large scale in the protected forest area.
4. Learned counsel for the petitioner submits that from perusal of F.I.R., it is apparent that the villagers, who disclosed the name of petitioner and others, are in inimical terms with petitioner. He further submits that neither Khata number nor plot number of the lands in question are mentioned in the F.I.R., on which opium plants were being cultivated. 5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Barachatti P.S. Case No. 45 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
