Petitioner seeks bail in a case registered for the offence punishable under Section 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 4 of the Bihar Ban on Lottery Act, 1993.
670 mg. of smack was recovered from possession of co-accused Aashik Ali, who has been allowed bail, by order at Annexure-3 by a Coordinated Bench of this Court, vide order dated 01.04.2019 passed in Cr. Misc. No. 19397 of 2019. Name of the petitioner surfaced in the confessional statement of Aashik Ali.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.81874 of 2019(2) dt.18-12-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 17(A)/2018 arising out of Kishanganj Police Station Case No. 780 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
